1. Scope and operator

These terms govern the use of the Librea app and website ("Librea"), operated by Milan Tornier, Karlsgartenstr. 14, 12049 Berlin, Germany ("we", "us"). By creating an account you agree to these terms.

2. What Librea is

Librea is a platform that connects readers who want to buy, sell, lend, or swap second-hand books. We are not a party to any transaction between users. Contracts for the sale or exchange of books are concluded directly between the users involved. We do not handle payments, shipping, or delivery, and we give no warranty for the condition, authenticity, or legality of listed books.

3. Account

You must be at least 16 years old to use Librea. You agree to provide accurate information, keep your login credentials confidential, and not share or transfer your account. You are responsible for activity that occurs under your account.

4. Your content

You retain all rights to content you post (listings, photos, reviews, messages). By posting, you grant us a simple, revocable right to store and display that content within Librea for the purpose of operating the service. You must hold the necessary rights to everything you upload.

5. Rules of conduct

You agree not to:

• post content that is illegal, misleading, offensive, or infringes third-party rights;
• list items other than books, or books you are not entitled to sell;
• use Librea for commercial resale at scale, spam, or advertising unrelated to your own listings;
• harass other users, or collect or misuse other users' personal data;
• interfere with the technical operation of the service or access it by automated means.

6. Zero tolerance for objectionable content and abusive users

Librea has zero tolerance for objectionable content and abusive users. Objectionable, abusive, harassing, threatening, hateful, discriminatory, sexually explicit, or otherwise offensive content and behavior are strictly prohibited, with no exceptions.

We remove such content and terminate or ban the accounts of offending users. You can report content and block other users directly in the app. We review reports of objectionable content and abusive users and act on them — by removing the content and/or removing the responsible user — within 24 hours.

7. Meeting other users

Exchanges are typically arranged in person. Use common sense: meet in public places and take the precautions you would with any private sale. We are not responsible for the conduct of users online or offline.

8. Moderation and termination

We may remove content or restrict, suspend, or delete accounts that violate these terms or applicable law. You can delete your account at any time in the app settings. We may discontinue or modify the service with reasonable notice; claims arising before termination remain unaffected.

9. Liability

We are liable without limitation for intent, gross negligence, and injury to life, body, or health. For simple negligence we are liable only for the breach of essential contractual obligations (cardinal duties), limited to the foreseeable damage typical for this type of contract. Liability under the German Product Liability Act remains unaffected. Librea is provided free of charge; we do not guarantee uninterrupted availability.

10. Changes to these terms

We may amend these terms with effect for the future, for instance when the service or legal requirements change. We will announce material changes in the app at least 14 days before they take effect; if you do not object or continue to use the service, the amended terms apply.

11. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, mandatory consumer protection rules of your country of residence remain unaffected. Should individual provisions of these terms be invalid, the remainder stays in force.
